【中文摘要】以"国家亲权"和"康复"理念为特征的美国少年法院及少年司法制度在20世纪80、90年代青少年犯罪率持续增长的背景下逐步转型，趋于硬化，并逐渐向成人刑事司法制度靠拢，传统的少年法院的福利性基础遭到动摇。然而，少年法院的理念已深深植入美国的法律文化当中，并且除了该制度的模式外，目前美国还没有更有效的替代机制。美国联邦最高法院于2005年和2012年对罗珀诉西蒙斯和米勒诉阿拉巴马州两案所作的判决或将对美国少年法院未来的走向和青少年犯罪控制产生重大影响。

    2005年3月和2012年6月，在备受美国公众瞩目的两大法律诉讼案件，即罗珀诉西蒙斯（Roper v．Simmons）和米勒诉阿拉巴马州（Miller v．Alabama）的判决中，美国联邦最高法院推翻了下级法院的判决，宣告现存的"对未成年犯适用死刑"和"对未成年犯适用终身监禁不得假释"的法律规定违反了美国联邦宪法，应予废除[1]。最高法院作出上述两项判决的主要法律依据是，美国联邦宪法第八修正案中明确规定："禁止残酷的和非常的惩罚"{1}。这一判决结果意味着美国刑法中两项针对未成年人的重要的法律条款从此失效。自此之后，未成年犯不仅不得被判处死刑，而且也不得被判处终身监禁不得假释。两项判决传递了一个十分明确的信息，即美国最高法院在少年司法问题上的立场发生了重大改变，出现了向传统的福利型少年司法制度回归的迹象。这无疑将对该制度的变革施加重大影响，对当今美国少年法院的命运增加新的不确定因素。
